A Wisconsin Rapids man could see fines and jail time after allegedly resisting a police officer during an arrest.
Frank Curry IV pleaded not guilty to charges of resisting or obstructing an officer and disorderly conduct at his initial appearance in Wood County Circuit Court on September 28. For the misdemeanor charge of resisting an officer, Curry faces a maximum sentence of up to nine months imprisonment or a $10,000 fine or both. The disorderly conduct charges comes with a maximum sentence of up to 90 days imprisonment or a $1,000 fine or both.
Since Curry was found guilty of charges of bail jumping, theft and resisting an officer in August 2014, he is identified as a repeat offender and up to two years imprisonment can be added to each of his charges.
According to court documents, a Wisconsin Rapids Police officer responded to an ambulance call on the 2400 block of Third Ave. S. on September 4. The ambulance was called in response to a male acquaintance of Curry’s who had overdosed. Police said Curry would not help in identifying the male who had overdosed.
When the police officer identified Curry, he ran his name through a database to search for any outstanding Warrants. Curry then allegedly became “extremely agitated.” Police say he asked them why he was running his name and began speaking loudly, yelling profanities and calling him a “racist pig.”
Due to his alleged behavior, the officer decided to arrest Curry. When he told Curry he was under arrest, Curry pulled out his phone and began video taping the officer. The officer claimed to have asked Curry over 20 times to place his hands behind his back and he refused.
Another officer soon arrived and observed Curry’s reported non-compliance. The officers grabbed Curry’s arms and tried to place them behind his back but reported he remained uncooperative and resistant during the process.
Curry was free the same day on a $2,500 signature bond.
Curry returns to court on October 30 at 10 AM for a pre-trial conference.
